Section 370 and 35A

The Government of India decided to remove Article 370 from Jammu and Kashmir.


Article 370 has been announced to be removed from Jammu and Kashmir. Union Home Minister Amit Shah today In the Rajya Sabha, it was proposed to remove article 370 from the state. Shah said that this proposal was called by Parliament Can be passed by a simple majority.





What will change in Jammu and Kashmir after article 370 is removed :-

  • Now any citizen of the country will be able to purchase property in Jammu and Kashmir.
  • There will no longer be a separate flag in the state of Jammu and Kashmir.
  • The police administration of Jammu and Kashmir will remain under the jurisdiction of the Center.
  • Dual citizenship will now be abolished in Jammu and Kashmir.
  • Jammu and Kashmir will be a union territory.
  • Kashmir will be the Union Territory. The term of the Assembly will be 5 years instead of 6 years.
  • Any citizen can now get a job in Jammu and Kashmir.
  • Laws like RTI and CAG in Jammu and Kashmir will also apply here.

What is Section 370 and 35A?

In view of the emergency situation at that time, there was no time to complete the constitutional process of merging Kashmir with India. Hence In the Federal Constituent Assembly, Gopalaswami Iyengar introduced the draft Section 306-A. This was followed by Section 370. Under which Jammu and Kashmir Other states have got different rights.

Article 35A gives the Jammu and Kashmir government and the legislative assembly the right to decide the definition of permanent resident. it means That the state government has the right to protect the refugees and other Indian citizens who came from other places in Jammu and Kashmir at the time of independence. Do not give any kind of comfort or not.
